Sen. Dick Durbin, D-Ill., and Supreme Court nominee Brett Kavanaugh had a heated exchange Thursday about whether the hearing over an alleged sexual assault would be better served by an FBI investigation. Flake said he was motivated to call for a delay as a way to preserve the institutions of the Senate and the Supreme Court.
White House press secretary Sarah Huckabee Sanders said oversight of the investigation belonged to the Senate.
Investigators compile information about the nominee's past and then provide findings to the agency that requested the background check - in this case, the White House. It's a Senate process.
"The Senate is dictating the terms", she said. "The FBI is not tasked to do that".
Attorneys for Ford praised the decision to reopen the probe and added, "No artificial limits as to time or scope should be imposed on this investigation".
Deborah Ramirez accused Kavanaugh of sexual misconduct while they were in college and she had been seeking an FBI investigation. "They have free rein to do whatever they have to do". They're going to do whatever they have to do, whatever it is they do. "From the very first moment [Kavanawugh was nominated], Democrats said, 'We're not going to support him, we're not going to vote for him.' And they were going to do everything within their power to fight him". "And hopefully at the conclusion everything will be fine".
Swetnik said in a sworn statement this week that she knew Kavanaugh in high school and was raped by such a group at a party where Kavanaugh and Judge were present.
Testifying after Ford, Kavanaugh denied ever attacking her in an emotional rebuttal.
President Donald Trump said on Friday that he acceded to a request from the Senate Judiciary Committee to have the FBI investigate sexual abuse accusations against US Supreme Court nominee Brett Kavanaugh.
Ramirez, 53, told The New Yorker that Kavanaugh exposed himself at a drunken dormitory party, thrust his penis in her face, and caused her to touch it without her consent as she pushed him away at a party during the 1983-84 school year at Yale.
Kavanaugh has staunchly denied allegations from Ford, Ramirez and Swetnick.
An attorney for Leland Keyser, a friend of Ford's who Ford says was at the party, said Keyser also was willing to cooperate with the FBI investigation.
"In order for the FBI investigation regarding Judge Brett Kavanaugh's nomination to be complete, it is imperative the bureau must not only look into the accusations made by Dr".
"The committee took the claim seriously and questioned Judge Kavanaugh about the allegations under penalty of felony", the Senate Judiciary statement said.
The FBI conducts background checks for federal nominees but does not make judgments on the credibility or significance of allegations.
There has been a pattern of leaks, Cassidy said, to assassinate Kavanaugh's character. Kavanaugh has denied being the perpetrator. The Senate Judiciary Committee voted in favor of Kavanaugh along party lines Friday.
The senators eventually returned, and Flake announced that he would still vote to advance Kavanaugh's nomination, on the condition that a final vote would be delayed no more than a week to allow for an investigation. When investigators have completed their work, anything they've discovered will be turned over to the White House as an update to Kavanaugh's background check file.
